Writing in Commercial Observer, Wacht argues that while the legislation is well intentioned, it is likely to do more harm than good — making landlords more selective about who they lease to, locking out the mom-and-pop tenants the bill claims to protect, and disrupting the natural turnover that allows new businesses to enter the market. He also warns of a cascading financial effect: suppressed retail rents reduce property values, which in turn shrink New York City’s already strained tax base. His conclusion is direct — the city’s retail landscape needs flexibility and investment, not more constraints.
